Legislation against child sex tourism

Laws and regulations which can be used to:

  • prohibit or prevent the organization and advertising of sex tours and trips
Penal Code Act No 166, 168, 169, 170 and 171

Between 14 & 16 years Art. 168 no. 1&2. Coitus or coitus anal sex with a minor, abusing their inexperience (virginity)

Art. 169. Practice of sexual act with a minor, abusing their inexperience, or induction of minor to do this act with third person

Up to 4 years imprisonment



Up to 3 years imprisonment

  • for the manager, controller, pimp or owner of a prostitution place

Art. 170 no.1. Promote, encourage or facilitate practice of prostitution of minor or practice of sexual acts 

Art. 170 no.2. If the agent uses violence, grave threat or fraudulent maneuver, or if the minor is under 14 years

Article 171 stipulates that the above mentioned penalties are aggravated by another one third, in its minimum and maximum limits when: 

no.1a) The victim is an offspring, adopted, related or 2nd degree relationship to the agent or if he or she was the guardian or curator; 

no. 1b) The victim encounters relations of hierarchical dependence, work relations with the agent, and if the crime was committed based on this dependence. 

no.2 The agent was a carrier of sexually transmissible illness. 

no.3 These punishments are aggravated by another half, in its minimum and maximum limits when the above mentioned result in pregnancy, grave offence to physical integrity, HIV, suicide or death of the victim.
